Alleged theft: Court issues bench warrant against security guard 

A Chief Magistrates’ Court in Wuse, on Monday issued a bench warrant authorising the arrest of a 47-year-old security guard, Teryima Joseph over failure to appear for trial.

The Magistrate Hafsat Amiru issued the warrant following an oral application made by the prosecution counsel, Okokon Mbruk who noted that the defendant was absent from defending the charge against him.

” I have two witnesses in court which are the complainant, ACP Alex Ebbah and the Investigating Police Officer. I urge d court to invoke sections 394 and 183 of The Administration of Criminal Justice Act (ACJA) to issue a bench warrant against the defendant,” the prosecution said.

Amiru ordered that the defendant’s surety should be served with notices to show cause, why the bail bond entered, should not be forfeited.

She adjourned the matter until Nov.12 for hearing.

The police charged the defendant with theft by servant which he pleaded not guilty to.

Earlier, Mbruk told the court that the complainant, Ebbah reported that the defendant, his private security guard siphoned diesel from his generator plant on June 16.

He alleged that the defendant switched off the entire house cameras and entered the complainant’s apartment and stole 200 dollars, N2 million,  a Mac book,an apple laptop and two gowns.

Other items include two purses, wristwatch and food stuff belonging to the complainant’s wife.

The offence, he said, contravened the provisions of section 287 of the Penal Code.
